# Cancellations due to extenuating circumstances

Boatsetter understands that unforeseen circumstances beyond the reasonable control of any person may result in the cancellation of a booking. Boatsetter can supersede the standard [cancellation policy](https://support.boatsetter.com/en_us/cancellation-policy-ryTZ81jno) and offer a full refund if the following extenuating circumstances occur:

  

*   For bookings within 150 miles of named or numbered storms (the timeframe for cancellation may vary based on the condition of the storm). Boatsetter suggests using the [National Weather Service](https://www.weather.gov/) as a reference for those boating in the U.S.
*   Weather-related cancellations are subject to the discretion of the Owner and/or Captain. In the event of qualifying natural disasters or severe weather conditions, Boatsetter may override the Owner’s cancellation policy to ensure the safety of all persons. Valid severe weather conditions include government-declared weather emergencies or advisories that affect the location and duration of the booking. Natural disasters or other severe weather conditions do not qualify as a valid extenuating circumstance unless they are in effect within eight hours of the time of the scheduled rental. Common and foreseeable weather conditions, such as rain storms in Florida, do not qualify as a valid extenuating circumstance.
*   Air Quality Index (AQI) readings over 150 in the rental area on the rental start date. Boatsetter refers to [Air Now](https://www.airnow.gov/) for air quality ratings. AQI readings from other websites are not accepted.
*   Owner cancellation, [no-show](https://support.boatsetter.com/en_us/additional-fees-and-fines-ByEE8yohs), or no access to the vessel. In this case, the Owner may be subject to penalties.
*   If the description of the Boat in the listing on the Site is materially inaccurate (the vessel must not be accepted by the Renter in order to receive a full refund).
*   Cancellations due to a Renter’s transportation disruptions are not a valid extenuating circumstance and are subject to the Owner’s cancellation policy unless the transportation disruption was directly caused by a valid extenuating circumstance.
*   In some cases, Boatsetter may need to cancel a trip after booking to protect our users against fraud or for trust and safety considerations. Boatsetter will notify both the Owner and Renter in such events. 

For the above extenuating circumstances, the Renter will receive a 100% refund and the Owner will not receive payment.

Either party can cancel due to extenuating circumstances by contacting us via our [Contact Form](https://boatsetter.kustomer.help/contact/contact-us-rybdP8n5i) and must provide documentation to support the cancellation. All cancellations due to extenuating circumstances will be reviewed by the Boatsetter Support Team.
